1. Commercial Philosophy

Unlike selling a physical product (like a laptop) that can be returned and resold, WebDesign.gy sells Intellectual Property, Expert Labor, and Time. Once our architects have spent time engineering your strategy or writing code, that time cannot be “returned.”

Therefore, our Refund Policy is strictly Milestone-Based. This protects the Client from paying for uncompleted work, while protecting the Agency from uncompensated labor.

2. The Mobilization Fee (Deposit)

All projects require a non-refundable Mobilization Fee (typically 50% of the total project value) to secure your deployment slot.

  • Purpose: This fee covers the reservation of our development team’s time, the setup of your staging environment, and the initial administrative costs of onboarding (KYC checks, contract preparation).
  • Cooling-Off Period: If you wish to cancel the project within 24 hours of paying the Mobilization Fee, and before the “Project Kickoff Meeting” has occurred, we will issue a full refund minus a 5% administrative processing charge.
  • Post-Kickoff: Once the “Project Kickoff Meeting” has occurred or the first “Design Concept” has been delivered, the Mobilization Fee becomes 100% non-refundable.

3. Milestone-Based Refund Schedule

If a cancellation occurs mid-project, the refund eligibility is calculated based on the production stage active at the time of formal written cancellation.

3.1 Stage 1: Design & Architecture Phase

  • Status: The “Kickoff Meeting” is complete, but no code has been written. We are in the wireframing/design layout phase.
  • Protocol: If you cancel during this phase, you are not liable for the remaining 50% balance. However, the Mobilization Fee is retained by WebDesign.gy to cover the design labor.

3.2 Stage 2: Development & Coding Phase

  • Status: You have approved the design, and we have begun coding the “Alpha Version” of the site.
  • Protocol: Cancellation at this stage initiates a Kill Fee. You will be liable for the Mobilization Fee plus 50% of the remaining balance. This covers the engineering time allocated to the build.

3.3 Stage 3: Pre-Launch / Beta Phase

  • Status: The site is fully coded and is currently on the staging server for your review.
  • Protocol: No refunds are issued at this stage. The full project value is due. We have fulfilled our obligation to build the product.

4. Cancellation Process

We do not accept cancellations via WhatsApp, SMS, or voice calls.

  • Formal Notice: To cancel a project, the “Project Lead” designated in the Master Services Agreement must send a formal “Notice of Termination” to our official billing email.
  • Effect Date: The project is considered “Cancelled” on the date this email is acknowledged by our administration team (typically within 1 business day).

5. Post-Launch Support

Once a website has been deployed to the live server (the “Go-Live” event), the project is legally deemed “Accepted.”

  • No Returns: There are absolutely no refunds on completed, live websites.
  • Warranty: Any issues discovered after launch are handled under the 30-Day Support Warranty (fixing bugs), not via refunds.

6. Project Dormancy (The “Ghosting” Clause)

If a Client fails to provide necessary content, feedback, or approvals for a period exceeding 30 days, the project is classified as “Dormant.”

  • Re-Activation: To restart a Dormant project, a Re-Engagement Fee of $250 USD may be applied to re-allocate resources.
  • Abandonment: If a project remains Dormant for 90 days, it is considered “Abandoned.” The contract is terminated, all deposits are forfeited, and all project files are archived.
